drainage onto my property

The house that sits on land above my new house has drains from their downspouts running and draining onto my property. We recently discovered this as we were having the final grading done for our almost completed home( In PA, Franklin County). The property developer has spent a month trying to get this resolved but has not. What can/should I do??

If you do not already own [have legal title to] the real property/lot, you may be able to refuse to complete settlement until the developer satisfactorily resolves the problem with the neighbor.

If your home is in a planned community development and the neighbor's home also is, the neighbor should be bound by all of the community rules, as well as the law against permitting water to drain onto other's property.

You should consult with a real estate attorney in Franklin County PA to review your contract and other documents and advise you of your rights and obligations.
