evictiion of tenant

I am evicting my tenant-I already have court order. By now when I try to schedule sheriff's appointmnet I did get answer from office that my tenan file petition against me for unliving condition in a my apartment and breaking his apartment what is not true.

What can I do now?

If you have a court order for possession the constable should schedule a lock out date. Did you get an order of possession? Call my office so we can further discuss.

Sounds like your tenant appealed the DJ decision. To do so he must have filed an appeal with the court of Common Pleas and served the appeal via certified mail.

To get a stay on the money owed he had 30 days to appeal. If he wanted to avoid the eviction he had to file in 10 days and pay the money owed for went to the prothonotary.

To find out you need to call the Prothonotary at the court house.
