Legal Question in Real Estate Law in Pennsylvania

Mortgage

My name is on the morgage with my ex-spouse. She is living in the house. The property settlement agreement states that she will have my name taken off the morgage asap. Its now been over 8 years and my name is still on the morgage. She says that her credit is bad and she can't get a loan. How do I finally get my name off the mortgage? Thanks Jeff.

Your written agreement must be reviewed by legal counsel. The mortgage company can be asked to have you removed, but the chances are slim if your ex wife has been late with her mortgage payments. If there is substantial equity in the real estate the4 mortgage company may agree to release you. As long as you have liability on the mortgage your credit will be effected.
