Legal Question in Real Estate Law in Pennsylvania

Receiving of a gift

Received engagement ring on 12-21-05. Told early X-mas present. Broke up. I want to sell the ring. He said that he is taking me to court. Who is right?

Re: Receiving of a gift

No one.

As a guy I say the ring should go back. It was essentially a promise. There was an informal quid pro quo when you accepted the ring and said yes you will marry the guy.

But then a gift is a gift.

If either of you force this matter to go to court you are both being overly petty and deserve that this becaome a long protracted matter. Hopefully one that costs more than the value of the ring.

Courts have come on both sides of this matter and both of you have as likely a chance of losing.

Now the question is, who is more adult and comes to their senses first?

In all seriousness, consider the relationship over and return the ring. It was an engagement ring, and likely much more expensive than any present you would have otherwise gotten.

Then again, may it's a cubic zirconia.
