renting a home that is for sale

When you are renting a home that has been for sale and it goes under contract, by law how much time does the landlord have to give you to vacate the premises?

It all depends on what your lease says. Sometimes an owner who plans to sell will include a provision in the lease saying that if the house is sold, the tenant will have to give up the house. Such a provision will also usually state how much notice the tenant will be entitled to.

During the term of the lease, except for such a provision, you are entitled to remain in the home. A buyer would receive the same rights as your old landlord - to receive rent from you - but would not be able to just terminate the lease.

You may want a real estate attorney to review your lease and any notice you may have received from the new owner to help you assess your rights.

The most important fact is that your lease must be reviewed. Unless you are month to month, if a landlord sells his property the new owner will buy it subject to the lease. I suggest you have your lease reviewed by an attorney. Once the property is sold you will have a new landlord and be required to pay the rent to him and not your own landlord.
