Rights of property owners vs RE mgt companies

I contracted a RE management firm to take care of a property of mine 100 miles from my home. First 5 yrs were fine, however this year the owner truned the management of my property over to his son, On 10/1 the tenants were 2 mths behind in rent, wnet to visit mgt company, son advised if rent not paid by noon 10/12 he was filing for possession that afternoon, he never did,tenants still there owing 5 months rent, called son this week and he advised he was ordering a sherriffs sale on 12/27/07 to sell their furninture and their car, they owe around 4300.00. Do I have any recorse against the mgt co since they made promises they never carried out and not acting in my best interests?

Your rights are going to depend on what your contract says they are.

So without reviewing the contract it would be hard to say what your rights might be.

Even without seeing the contract they management company owes you a duty of managing your property with the same level of care other property management firms would use.
