Need signature by multiple parties for sale of share - one party unavailabl - ca

I am trying to obtain 1/5 of a piece of land jointly owned by 5 members of my family. Four members are easily accessible but the other lives out of state. Can I fax him the seller's agreement to sign and have him fax back or maybe have a notary witness signature by proxy?

Your question is not clear. I assume you want a tranfer of ownership via a deed. The deed must be notarized in front of a notary and not by proxy. I suggest that the signature be notarized in front of an out of state notary. That is sufficient. The other way to effectuate a transfer is to obtain a power of attorney from the out of state resident. I suggest you consult an attorney. Gerald Hershenson Esq. 215-579-9390
