Legal Question in Sexual Harassment in Pennsylvania

Reading material in a lavatory.

In a unisex bathroom, are you able to store magazines that are written for men (i.e. Maxim, FHM, Stuff), which contain no pornographic material.

If this is not allowed, are you able to get around it by labeling a ''men's drawer'' and ''women's drawer'' in the bathroom cabinet.

The bathroom is a unisex room used by 6 men and 1 woman, and has base cabinets with individual drawers in which we keep magazines and reading material.

I am not familiar with the magazines you mention. What about them would make them offensive?

It is a good policy not to allow any material that would be offensive (create a hostile environment) to any particular subclass of employees. And, it may be more problematic to label something "men's drawer" and "women's drawer," as this would tend to set up a discriminatory category of who can go into each drawer.

There truly is no need or appropriate place for any material that could be considered to be sexist, racist, etc., in the workplace. A workplace is just that...a place to work.
