Can't Find Mother's Will

Mom was accepted into Hospice care in May, as she needed someone to stay with her 24/7. As I was the only one who didn�t work outside the home I stayed with her at her house until she died this past week, only going home to my own family for a weekend every two weeks while one of my siblings visited and helped take care of Mom�s needs.

Nobody expected the end to come so fast.

A week or so ago I asked if she had made plans for her property, and she said, �Of course I�m leaving everything to my kids!� but nobody ever asked if she had actually made a will. We�ve been looking but so far haven�t come across any such document.

She owns about 9 acres that used to be part of a farm in a rural part of the state, and a small trailer is on the property as her home burned down a couple of years ago. The 5 of us, my brothers and sisters and I, are talking about keeping the property in the family as an �escape� from city living, maybe putting a larger trailer on the land and having family get-togethers there over the years.

How long can we search for the will and wait before doing anything? She had lived a very retired life for the last 20 years; my father died over 30 years ago, long before she inherited the property.

Sorry about your loss.

You may want to check with her attorney to see if s/he drafted a will for her.

If no will, the estate will fall under the rules when one dies without a will.

If all your siblings agree on the disposition of the property this should not be a problem.

Find an attorney to help you with the process.
