Legal Question in Workers Comp in Pennsylvania

Assistive Technology

Are there stipulations surrounding when Workers' Comp will pay for Assistive Technology (Durable Medical Equipment)? For example, will they only provide what is deemed necessary to enable the injured worker to return to work, or will they cover anything needed?

Re: Assistive Technology

Under the Pa. Workers' Compensation Act, the insurance carrier is responsbile for for reasonable surgical and medical services, payment of medicines and supplies, hospital treatment, services and supplies and orthopedic appliances, and prostheses. See Section 306(f.1) of the Act.

However, the are only responsible for the above if it is "reasonable and necessary" and related to the work injury. As long as your doctor or health care provider provides the medical equipment to you and properly bills the workers' comp insurance company, you should be fine. The law does not allow the health care provider to seek payment against you if it was covered under workers' compensation.
