Legal Question in Workers Comp in Pennsylvania

Comp Nurse at Dr Appt.

I just got a call from a Comp Nurse saying she was going to be at my Dr appt. tomorrow. She said the Dr ok'd her to be in the exam room with me as long as I say it's okay. Should I feel comfortable with this??

Because I don't! I have nothing to hide.....just not sure what to expect.

I'd probably object to that. I don't think the employer's insurance company is entitled to have a representative present and I think that's what this sounds like.

I am suspicious of such requests as an affront to doctor-patient privilege. Is this a physician whom you selected or a List doc? If the former, then no if the latter, then perhaps.

Sometimes, you catch more flies with honey than vinegar. but the doc may be trying to test you for "symptom magnification" (i.e. faking) with her acting as a type of corroborator, or have another forensic objective instead of just treating you.

If the exam is a so-called "Independent Medical Exam" then run, don't walk, to your own Comp Lawyer.
