Legal Question in Workers Comp in Pennsylvania

Who is responsible?

My husband incurred a back injury at work on 03/13/07. After completing several tests he was released back to work on 03/26/07. Workman's Comp paid his wages from 03/20-03/25. Who is reponsible for his lost wages from 03/13/07-03/20/07?

Re: Who is responsible?

the responsible entity is probably the same carrier who previously paid. yo may need to hire an Atty to establish their obligation.

is there a governing document? did your Husband sign a final receipt or supplemental agreement?

Good Luck

Re: Who is responsible?

If your husband was out of work 1 more day WC insurer would have to pay. Under PA WC Law, WC doesn't pay for 1st week of disability unless employee is disabled more than 2 weeks. So, ins co pays for disability days 8 - 15 & thereafter, but only has to pay for days 1 -7 if disability is at least 15 days. Your husband can use sick time for the days not paid by WC.
