Legal Question in Credit and Debt Law in Philippines

Hi

I just want to inquire if i can file a case to a person who i rented a private car, unfortunately i make an accident and she told me to pay cash for the repair and once they get the insurance they will bring back my money all of this is written and sign by her. Can i file a case against her as he already get the insurance money but till now she's not paying.
