Child with different last name

3 children involved, 1 w/ boyfriends name & 2 w/Mothers name.Mother coming to US under Fiance Visa.No trouble with 2 w/her name. How can she get a passport for son with boyfriends name? Can she get passport for him & get name fixed here, or will they stop her from bringing him.Never been supported by boyfriend/never seen or been around them.Boyfiends Mom signed birth cert without real Mom aware until after.Now going for her interview to come over here and is afraid they will stop her son.What can we do??

If you want the child's name to be changed so that he will bear his mother's surname, the change should be done at the place (city or municipality) where his birth is registered.

As to whether he can come with his mother who is going to the US on a fiance visa, it would best be answered by a US Immigration Lawyer. The rules as to who should be admitted entry into a country's territory depends solely on the law of that country, in this case, the US.
