Legal Question in International Law in Philippines

Hi ask ko lang po yung friend ko po ay nghahanap ng legal advice.my problema po sya about her boyfriend, her american boyfriend my 2 yrs. old na anak ng isang filipina but their not married.yung boyfriend nabigyan niya yung bata ng american citizen pero plano nung biological father na dalihin yung bata sa US for vacation pero wala na itong balak ibalik sa tunay na ina.Pwede pwede bang magsampa ng kaso at pwede pa ba niyang mabawi yung anak niya kahit nasa US na ito?

Yes, but it will be very costly. The mother can avail of the remedies provided under the treaty involving INTERNATIONAL CHILD ABDUCTION to which the US is a signatory. She can visit the US Embassy and invoke this Treaty. Since the child is illegitimate the custody should be to the mother or if the child is below 7 years old the maternal preference rule is applicable.This means the child's custody belongs to the mother
