Legal Question in Family Law in Rhode Island

Divorce in ri

In 2000 my father left my mother for his secretary - 2 months after celebrating their 25th anniversary.

My dad's girlfriend thinks they are divorced, and my dad gave her a diamond a few years ago.

Parents wed at 17, and it was my dad's choice for my mom to stay home and raise three children and support him as he moved up the corporate ladder.

Essentially, she has no formal education. She has worked menial jobs since- cannot make more than $10/hr.

She has mentioned divorce to him several times, but cannot afford a lawyer to do it herself.

He ''pays'' her a measly $300 month, and is afraid of losing that- we are all grown- would she be awarded alimony? Can he get in trouble for having a fiance who doesn't know he is still married?

Another thing is that dad is a big wig at amtrak- and my mom gets a pension, she is afraid to lose if they get divorced.

Any input or direction would be greatly appreciated.

They lived in ri for most of the marriage. Dad now lives in mass. And mom still lives in ri.

Dad pretty much has alienated our whole family, hardly knows his grandchildren.

Thank you.

Re: Divorce in ri

If all is as you say, your Mom has nothing to fear. She'll get alimony, half his pension and half the assets, and, yes, he will get in trouble for the girlfriend. Don't worry about the lawyer's fee. Call me asap, time is your enemy.
