Legal Question in Landlord & Tenant Law in Rhode Island

Security Deposit

I was looking to move to an apartment in Rhode Island, when the whole process began I had filled out the application with my boyfriend. The day that I was to sign the lease, he decided he didn't want to be tied down to a year lease but I didn't mind. So we asked the management group whether one if we could get the security deposit back, they said no but then I said I was willing to be responsible for the lease myself. My credit score is 579 - 597 and I make about 35K or so a year. The rent is $825. If I am still willing to sign the lease, can they deny me and keep my deposit. Or is it one or the other?

Re: Security Deposit

Miss:

I fear the facts as stated in the question must be in error, as typically a security deposit is paid only upon signing the lease. And if no lease is signed - as if the management company denied your application to rent alone - then they would have no right to keep a security deposit.

Could you be referring to an application fee?

If you call our office I will be happy to take 15 minutes or so to discuss with you at no cost or obligation.

Best wishes,

Scott
