Legal Question in Discrimination Law in South Carolina

Uncomfortable situation at work...

I work in the HVAC industry. I am 20 years old, a female, and a lesbian. My boss is my uncle. Constantly we joke about my sexuality, which is fine with most of the employees, but one technician in particular hates me because of just that. He is a sexist and a homophobe. My uncle/boss senses tension and is forcing me to ride with him to calls which I am very uncomfortable with. I am a CSR and this is not in my job description. He is aware of this, but is threatening my job if I do not comply, regardless of the fact that I am uncomfortable. Is this legal? I am aware of the at-will law, but even though I'm ok with jokes from certain people, I feel I should not be forced to leave my duties to be alone with someone I am uncomfortable with, away from the workplace.

Re: Uncomfortable situation at work...

I do my best with all of the many different types of legal questions that I get asked on here. Unfortunately I do not know everything, including the answer to your question. I have two suggestions. One, go back and re-post your question under a category more related to Employment, instead of the Discrimination category that you used. And two, you can look in the yellow pages under the Attorney listing and towards the back they have listings under specific area of practice. You should call someone who specifically practices either Employment Law or Labor law. Wish I could have been more help. Good luck. My main areas is Criminal Defense and Personal Injury. If you ever have a question in those areas you are welcome to call or email. [email protected]
