You've asked a good question. I would answer your question if I could, but I'm afraid I do not have enough information. I do not know what the prosecutor is basing his/her decision on. If I had the police report I could probably advise you. I'm assuming you do not have an attorney. You really should talk with one. Its possible that the prosecutor is thinking you were on some sort of drug. Alcohol is not the only substance that applies to a DUI. Any substance that can impair a person's ability to drive qualifies under the statute. If you cannot afford an attorney, see if you can get a consultation with one. Your question requires more information in order to answer it. Good luck
