Legal Question in Family Law in South Carolina

Divorce

My husband and i bought the house after we were married we put it only in his name because of the student loans i had that would leave us little money to find a house with. We want to divorce, we have three children and have been in the house 2 years, i will have the children and we are divorcing because of his infidelity. Do i have any legal right to staying in the house with the children and him not being able to sell it?

Re: Divorce

The Family Court is not as considered with how the asset is titled, so long as it's titled in your name, his name, or both. Based on the facts you describe, the Court can allow you to stay in the house, either short or long term.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
