Legal Question in Immigration Law in South Carolina

Out-of-Status and Marriage

We want to marry and he is an overstay tourist. I see other similar questions and answers, I would just like a current one! Will marriage cure so that he can get a SS# and work permit, and then we could continue to apply for the documents for green card over time? Should we file ourselves and where is the best place to get the necessary applications? Thanks for your time!!

Re: Out-of-Status and Marriage

The simple answer is yes, it is possible for marriage to a "US CITIZEN" only can help cure the fact that he overstayed as a visitor. There are several variables involved including making sure he does not have any criminal record. With that said, I would strongly recommend that you use an immigration attorney. It will cost a decent amount of money between attorney fees and filing fees but you'll know that things are being done properly by someone experienced (the last thing you need is something going wrong with the filing and then he does not have a green card and the government is aware of his unlawful status). If you'd like to discuss the case further my office can help you as well (the distance is not a problem).
