Legal Question in Intellectual Property in South Carolina

My girlfriends dog got into the trash and became sick for two days, then we started to see improvement for the next two days, on the fifth day day, the dog took a turn for the worst and we had to bring him to the vet. The vet told us that she would perform the emergency surgery and that proceedure would be over $3500, and that if we could not pay for it the dog would have to be signed over them and put up for adoption. Well the dog is out of surgery, and we have agreed to pay for it. But now she is refusing to let us have the dog back claiming it was owner neglience. She also stated that the vet-tech would be adopting the dog for her daughter who has fallen in love with it, and that the tech would not have to pay the $3500. Can she do this? Steal her dog for an employee's daughter?
