Legal Question in Legal Malpractice in South Carolina

SC State Charge of Criminal Domestic Violence

My attorney failed to show up at my State CDV hearing.I went to the trial pro-se (by neccessity) & charge was dismissed instead of 'guilty' by bench trial. Do I have right to protest monies paid? I received no representation.

Your question is a little hard to answer without knowing what you and your attorney agreed to. Usually when you hire a lawyer to represent you for a criminal charge, he/she will notify the court of the representation, will request a jury trial and the bench trial will be waived. I'm not real sure why you were at the bench trial. I assume you have discussed this with your attorney. If not, then that is your first step.
