Legal Question in Civil Litigation in South Dakota

Taped Police Interviews

We are in the midst of a lawsuit involving a forest fire. The defendants subpoenaed a copy of a taped police interview with my father. The police gave them the only copy of the interview. The defendants did not provide us the tape during discovery, we are only just finding out about it. Did the police act correctly in giving them the one and only copy of the tape and not notifying us?

You say that you are in a lawsuit, do you have an attorney? If so, you should discuss this with your attorney. If you do not have an attorney, I highly recommend you get one ASAP. Dealing with discovery issues is not something you should do on your own.
