Legal Question in Business Law in Tennessee

If I signed a non compete in 1998 in Tennessee and was promoted within the same company when I was promoted it was written as an offer and the offer stated I must sign a non compete every year, that did not happen on there end, would they be able to enforcre the first one?

Also they have had 6 other employees in the same postion I have leave since 1998, they took no legal action on any of them, now they want to pursue mine since I left last month.

Is this enforcable in Tennessee since they neglected to have me sign a new one in my agreement every year and they never gave me one to sign? and since they did not go after other ex employees that held the same postion and same agreement and went to work for competitors why would they have the right to go after me.

They also have one year severants packages for my co workers and refused to give me one, yet they want to go after me for non compete thats 12 years old?

Much depends on the actual language of the agreement you signed - it would be necessary to review the exact wording to determine the enforceability.
