Possession

I was charged with simple possession of marijuana and cocaine. I also got a Paraphernalia charge. I would like to know what the punishment is for these crimes.

In the Commonwealth: possession of not more than 1/2 oz. of marijuana is a Class 1 misdemeanor, punishable by a fine of not more than $2500 and/ or one year in jail; possession of more than 1/2 oz. but not more than 5 lbs is a Class 5 felony.

Possession of cocaine, a schedule 11 drug, is a Class 5 felony, punishable by one to five years

in the pentitentiary or in the discretion of the jury or judge, 12 months in the county jail with a fine of up to $2500.

Possession of paraphernalia with the intent to sell such would be charged the same as 1/2 oz. or less of marijuana (Class 1 misdemeanor) and carries the same possible penalty.
