Legal Question in Family Law in Tennessee

My husband left me and our son on the 1st of April, 2011. He refused to help me pay bills or even support our child. I got cought up in a legal issue and had to spend 30 days in jail. My husband called CPS and told them I was using drugs. I passed my drug test. CPS handed my son over to his father because I was going to jail. While I was in jail my husband tried to file an order of protection against me for no reason except that he is trying to take our son from me. What can I do?

I want to file for divorce. I want to have sole custody of our son and just give him visitation. I have been the only provider for our son since he was born and he is almost 2 now. My husband never lived with us either. How can I file a report against him for filing to false reports against me? How can I take my son away from him, how can I get my son back from him?
