Pending Law Suits

I recieved divorce papers that involves a 16 yr old son, no parenting plan was included and the child has been injured in two separate motorcycle accidents that involve law suits against the drivers, this was not addressed in the papers served either. My son does still live with his dad and we agree on everything else, what do I do?
