Legal Question in Insurance Law in Tennessee
Independent Contractor
We(my husband & I)have 32 Independent Contractors who deliver automobile parts. A sub-contractor had an accident and was at fault. She had liability insurance. The other party was injured and has sued. His lawyer contacted me and said our company was responsible for his damages because our Independent Contractor only had liability insurance. Can we be sued because this sub-contractor only had liabilty insurance? Can my husband and our company be at jeopardy when we were not involved in the accident? Do we need some type of insurance to further insure that this never happens again?

Was he an independent contractor or an agent? If he was an agent of your, then yes you can be held liable if he was on or about your business when the accident occurred.
