Legal Question in Employment Law in Tennessee

Termination due to to many unexused absences

I was suspended for two days because I went over the 12 day annual limit. My employer told me @ that time my request for FMLA (mother) wasn't ever recieved from her physican. I contacted her dr & received a letter from them stating their error. That would absorb 6 of those unexused absences. I sent a letter to a ''review board'' but received a letter stating their ruling stands.

Re: Termination due to to many unexused absences

You very well may have a claim for FMLA retailation or wrongful discharge based on the company's conduct. If the situation is covered by FMLA, then based on the contents of your email the company may have made a big mistake. To be sure you should consult an attorney who understands the FMLA.
