Legal Question in Landlord & Tenant Law in Tennessee

Misslead into signing a lease

When I moved to tennessee and began looking for an apartment. One thing I looked for was the ability to have a DirecTV dish installed. The leasing agent who showed me the apartment said that this would not be a problem. His quote was '' There are over 100 dishes up so its no problem at all'' He showed me an apartment with the understanding that it would be the one I would move into. The next day when I signed my lease I was told there was a deposit on the apartment I was shown but there was another apartment with the same floorplan that was available. I moved in on July 1 2005 and had my satilite installed. The agent gave me a sheet to give the installer which basically said that the dish had to be mounted on the balcony. However due to the positioning of the neighboring building the dish couldnt be mounted there. Instead it was mounted on a pole under the bedroom window of the apartment. In mid august I recieved a letter stating the dish was not installed up to standards. I called derectv and had an installer look to see if it could be moved. They said it could not. When I get home from work yesterday the dish is gone. Nothing is left. Management will not return my calls. CanI break the lease since I was told i could have a dish?

Sounds like a condition precedent to entering the contract. I would need to see the lease to determine the existence of any merger clause defenses, but you may have a case.
