Legal Question in Legal Malpractice in Tennessee

Baby delivery question

My baby was born with a bleed in her brain, that according to a Nurosurgeon and a Nurologist probably occured from a traumatic birth. The child was in NICU for 9 days and now has a dead space where the bleed was. Suction was used during delivery when my wife and the baby's blood pressure dropped from what was believed to be to much medication pushed through the epidurial. The doctors we have went to say only time will tell what damage there is to the child. Am I right to believe that someone else is responsible for this and the bills that allegedy came from a botched delivery and future bills that may stem from this? What do I do now?

There can certainly be a trauma that occurs during the delivery process. At this time, our office is involved in a similar case involving an injury which occurred due to forceps usage. Many times, the injuries from forceps and suction can result in severe consequences for the child. Hopefully, the bleed in your child�s brain will only be temporary.

We would need additional information to evaluate this potential medical malpractice case. For example: Did your wife develop gestational diabetes? Did she have excessive weight gain? Did the physician give you an estimated fetal size prior to delivery? What was her fundal heights at various times during the pregnancy? Had your wife had any history of difficult deliveries? What discussions, if any, took place concerning the risks of vaginal delivery versus c-section?
