Look up Tennessee's Wrongful Death Statute on the Internet. You will see that the right to sue for wrongful death goes first to the surviving spouse, and if that person is not living, then to the children or parents. The statute does not distinguish between children of the deceased living at home and those living away from the decedent.

In general the spouse has the primary right to bring suit. If she does not, however, the children can bring the claim. If you would like to discuss the claim feel free to contact me directly. Our phone and email can be found at hhpfirm.com
