Legal Question in Wills and Trusts in Tennessee

Changing a trust

My dad passed away and left a trust in place almost 1 year ago. The trust is set up that everything would go to our grandma until she passed on and then my brother and myself would split all assets and propertys. My brother and myself are power of attorney over the bills and medical desisions for my grandma. My grandma is 94 and not doing to well mentaly. She doesn't even remember who we are sometimes. She is threatening to remove us from the trust one moment and loves us the next. With my dad leaving the trust in place the way he wanted it to be can our grandma change the trust in any way?

Re: Changing a trust

The process generally used to change the affects of a presumably now irrevocable trust is "reformation." This process requires Petitioning the Probate Court for permission and authority to do so. I suggest you contact an attorney experienced in these matters for further guidance.
