Legal Question in Bankruptcy in Texas

Reaffirmation agreement question

Hi. I had bankruptcy (ch.7) discharged in Dec. 01. Now I am finding that my lawyer at that time did not file a reaffirmation agreement with my mortgage company. Therefore all this time, my mortgage payments had not helped me reestablish my credit. Whats worse, my credit union advises that since this is not being reflected in my credit report, I may be at the mercy of the mortgage company since they will not be obligated to give me the title whenever I pay-off the house. This has me bothered. Please advise at to what I could or should do. I was young when I filed the bankruptcy and did not really know much about this process 5 years ago.

Thank you in advance.

Re: Reaffirmation agreement question

I think somebody is giving you bad advice. You were not obligated to reaffirm your mortgage; if you continued to make payments on time, you have not breached the contract with your lender and they will still have to provide a release once you have paid off the loan.
