Re: Collection agency and an attorney

The collection agency can threaten to sue to collect the moon from your dad, but it doesn't mean they will prevail. Nearly all lawsuits include a petition for attorney's fees, but it doesn't mean every successful litigant recovers them. Many unscrupulous collection agents hold themselves out to be attorneys in order to intimidate debtors into paying outrageous amounts. Ask for information about their attorney so that you can contact that office and attempt to settle your account. Be aware that collection agencies must adhere strictly to both Federal and State fair credit acts. If they don't you may have a case against the collection agency. Consult an attorney.
