Contractor vs. Staffing Service

My partnet and I have a small contracting business we startd about a year ago. In September of 2002, we applied for credit at a staffing agency to assist in 1)payrolling some our current people, 2) providing a source of labor.

We were not given full disclosure of terms, I asked for this several time...I was told they would draw up a contract..but it nver happened. Now...I am behind on a payment, and they are threatening legal action, and trying to take my payroll employees away! On top of that, they are trying to force my partner and I to sign all of our invoices over to them.

noneof this seems right...HELP!!!!

Many of the threats made by bill collectors are not based on sound legal principals and cannot be carried through. On the other hand, you can't force a staffing company to work for free. Get caught up on your invoices and take care of the outstanding bills. Don't enter into any contracts at this time without consulting with a lawyer.

Get a lawyer, and get copies of every document you signed with the staffing company.
