Legal Question in Business Law in Texas

Patent Help!!!

I invented a trivia game and want to secure a patent. I have a general concept of the game and have applied to one my favorite topics; wine. But I also have other versions of this trivia game in the works for football, hockey and other topics. Do I have to file a utility or design patent for all types of the game or does one patent cover it all?

Re: Patent Help!!!

You need to speak with a patent attorney. If you look in the Yellow Pages, look under Patent, not Attorney.

You'll probably need to copyright the game, since another trivia game similar to Trivial Pursuits could not be patentable.

I'm not certain that a patent can be granted for a board game but I can help you file an application for copyright registration. Patents apply to useful arts that are novel and non-obvious with respect to prior art. Copyrights protect original expressions of authorship affixed in a tangible medium. I am a trademark / copyright specialist. Let me know if you'd like to know more.
