Legal Question in Construction Law in Texas

Home Builder breaking contract

We hired a home builder to build our house, he was suppose to be finished in 3 months vary small and simple lay-out, we were paying him ahead to complete the work, to our surprise we found out that he never paid the lumber company so the lumber company put a lean on our property not to mention other subs are now contacting us saying the have not been paid and threatning to also place a lean on our property. The builder has broken his contract in more ways than one. It has been 9 months now and we fired him because he is just dragging us along....we are now finishing the house our-selves and paying as we go, we are also paying the subs that the builder did not pay so that no more leans can be attached. I'd like to know what can be done legaly as now that small home we are building turned into not only a nightmare but the cost of a bigger more expensive home.

Thanks,

Susan

Re: Home Builder breaking contract

You can sue him for what it's costing you to complete the work he should have done, but that's about it. That would probably be a waste of time and money since you'd get a judgment that may be impossible to collect.
