Legal Question in Consumer Law in Texas

Motorcycycle Repair Shop Responsibilities

Brought my motorcycle to Golden Triangle Cycle Shop two weeks ago. My wife and I have filed for divorce. Yesterday 6/14/06, my soon to be ex-wife and her boyfriend went to the shop and picked up the bike. Do I have any legal rights to get the motorcycle back due to how this was done.

Is her name on the title? Any of the paperwork the shop had? Is this your only vehicle? If you were served with papers note you have a set time to answer.

If her name is on the title, she has as much right to the bike as you do. The shop has a duty to not give your bike to someone other than the owner, so if she's also an owner the shop isn't liable.

As a practical, legal, matter if you bought the bike while married, it's community property.
