Legal Question in Credit and Debt Law in Texas

Trying to collect payment for work completed.

My son has a roofing business in Dallas. He completed a job for a customer who now refuses to pay. There is no reason for this.The customer has gotten an attorney who has been evasive about talking to my son. He has a contract but feels as though his company is small and doesn't have the funds to take this man to court. What else can he do?

If the job was done within the last three months, he can file a Mechanics & Materialman's Lien on the property unless the property is homestead. He should see an attorney about properly filing.

If the debt is less than $5,000.00, he can bring suit in Small Claims where he doesn't need an attorney. If over $5,000.00, he should check around for a collection attorney that will handle the claim on a contingent basis.
