Legal Question in Credit and Debt Law in Texas

Collection Agency Request

Estate Account Representative is wanting detailed information. My mother passed away 2 yrs ago and had an unsecured debt with a credit card company (19,069.52). Are they entitled to any of the life insurance (which was used for funeral expenses)? They are wanting to know if any real property was owned at the time of death. Am I legally responsible, as executor, to furnish this information?

Re: Collection Agency Request

They are not entitled to any of the insurance money unless your mother's estate was the beneficiary.

You can either accept the claim or dispute the claim as executor. Bear in mind that if you dispute the claim, and lose, you may become personally responsible. If the estate does not have assets sufficient to cover the debt, let the creditor know. If there are sufficient assets, and the debt is legitimate, you'd best take care of it.
