Legal Question in Credit and Debt Law in Texas

Collection letter

Hi we recieved a letter well actually a cerdit card application to fill out in an attempt to collect a bad debt. This was never our debt, someone we used to know applied for credit cards using my husbands name and portraying herself off as me his wife. This was back in 1995. We hired an attorney and cleared everything up with the creditors. Now 10 years has passed and we heard from this ATT/Universal card place that sold the old account to a collections agency here in Texas. This is not our account by no means, we never heard from any collection agency about this in over 10 years now. I ran a complete set of credit reports earlier this month and there is no such company listed on the credit reports. We have our attorney on this case he gave the collection agency unly July 14, 2005 to get back with him along with the original credit card application, proof of the last time it was used and whom might have used it. Since this was not listed on his credit reports can it now be added on by the collection agency? What are our rights if any? Can you give us some needed information please. The name of the Collection Agency is PRM Financial Services from Addison, TX

Re: Collection letter

It would probably not be a bad idea for you to get an attorney to help you on this one - just to make sure this does not re-appear on your credit report. If you are in the Dallas area, feel free to call me. Otherwise, call a consumer lawyer from www.naca.net.
