Legal Question in Credit and Debt Law in Texas

My wife was recently charged with filing a hot check in Harris County Texas, on a check we stopped payment on. We had over the amount of funds for payment to be stopped on the day. We have documentation to show this. We recieved no notice from the payee regarding collection of the dispute. We would like the criminal aspect of this case to be rejected and have the matter disputed in small claims court. The check amount is for 1650.

Your wife needs a lawyer immediately. If you received the goods or services, generally the appropriate remedy is to sue the merchant, but not stop payment on the check. An attorney may be able to get this out of the criminal court arena, but it will be difficult.
