Legal Question in Criminal Law in Texas

My boyfriend was released from a TDCJ facility, then later charged with having possession of a cell phone while he was in prison. We had bonded him out, but neither he nor the bond company received notice of his court date. He missed his hearing and a new warrant was issued. He is currently in custody and has just been transferred back to the county where the charge originated (approx. a 5 hour drive). Can we get his bond re-instated and him released from jail due to insufficient notice? What kind of punishment is given for these types of charges?

Probably not. It is up to the defendant to keep up with his/her court dates. One cannot rely on a bondsman for notice of a court setting, although many bondsman do furnish that information to their clients and they are great about it.

What kind of punishment? Generally, he will be assessed more prison time, but how much has to be left to him and his attorney.
