Legal Question in Criminal Law in Texas

My child's father is in jail on a aggravated robbery & sexual assault but he didn't do anything the female is a prostitute who got mad because his co defendant stole her cell phone he's been incarcerated for 14 months already and haven't been convicted they have nothing on him and this is his very 1st felony case he just recently was about to sign for probation but the d.e.a denied it and the judge wasn't there is it possible that he could still get the probation so he can come home

The judge can still grant probation. I'd wait to see what happens to his co-defendant. Also he may want to try the case, especially if the complaining witness has a criminal record for prostitution..
