Credit card abuse is a state jail felony. You need to see a criminal defense attorney.

A very common way to use a friend's card is to have the cards switched at a restaurant.

If this happened and you used the card by mistake, thinking it was yours, you probably do not meet the elements of the statute.

On the other hand, if you knew you had the wrong card and continued to use it. You have a problem. The fact that you made restitution certainly helps. Also if this were to go to trial, the DA would have to prove that you knew that the card was not yours. However, you probably signed the payment vouchers which had your friend's name.
