Legal Question in Criminal Law in Texas

My laptop was stolen and found by the police at a pawn shop. My insurance company has paid me for the laptop, but has now waived their claim on it. The pawn shop is holding the computer under court order until a court date is set. Since my insurance company has paid me, and waived their claim to it, am I eligible to receive my laptop back or is it the property of the pawn shop now?

The laptop can't be the property of the pawn shop; they can't get good title from a thief.

The laptop belongs to you. The question of you having the laptop AND the insurance money is between you and the insurance folks, and doesn't involve the pawnshop guy at all. It's none of his business.
