Legal Question in Criminal Law in Texas

our rights as a family of an offender

Do we have the right to request a copy of the court reporter's notes or transcripts from a criminal court trial of our family member? Is it public record and can we get access to indictments, trials and convictions of a county court from other cases as well?

First, you can request the court reporter to type up the transcript of the trial. Please understand that unless the case is on appeal, there is no transcript. Second, a copy is not free, it usually cost you a $1.00 per page. You will need to call the court reporter and ask how much they think it will cost to do the transcript, if you truly want a copy.

As to copies of the court documents, go either the District or County Clerk's Office in the county where the Defendant was convicted. Usually, the County Clerk will have misdemeanor records and the District Clerk will have Felony records depending on the county you reside. The court documents; i.e., indictment, complaint, Judgment and Sentence are public documents, and can be purchased by anyone.
