Can he get a deferred? Most likely, although there are other options that may be possible depending on the facts. Do you need to hire a lawyer? Yes. If this is in Harris County, their policies frown on offering probation to folks who don't have lawyers.

Based on what you have written, your son may be eligible for deferred adjudication. There is a potential outcome, dependent upon the specifics of your son's case, which may be even better than deferred adjudication. You really need to consider hiring a local law firm to assist your son with protecting his rights and interests. Harris County generally does not offer these types of items to pro se defendants. My local law firm would be happy to discuss your son's rights and interests with you in more depth upon an initial meeting.
